(四)羁押期限届满，案件尚未办结，需要采取取保候审的。

下列情形之一的犯罪嫌疑人、被告人，可以监视居住：

(一)患有严重疾病、生活不能自理的;

(二)怀孕或者正在哺乳自己婴儿的妇女;

(三)系生活不能自理的人的唯一扶养人;

(四)因为案件的特殊情况或者办理案件的需要，采取监视居住措施更为适宜的;

(五)羁押期限届满，案件尚未办结，需要采取监视居住措施的。

对符合取保候审条件，但犯罪嫌疑人、被告人不能提出保证人，也不交纳保证金的，可以监视居住。

监视居住由公安机关执行。

第二百五十一条：下级人民法院接到最高人民法院执行死刑的命令后，应当在七日以内交付执行。但是发现有下列情形之一的，应当停止执行，并且立即报告最高人民法院，由最高人民法院作出裁定：

(一)在执行前发现判决可能有错误的;

(二)在执行前罪犯揭发重大犯罪事实或者有其他重大立功表现，可能需要改判的;

(三)罪犯正在怀孕。

第二百五十四条：对被判处有期徒刑或者拘役的罪犯，有下列情形之一的，可以暂予监外执行：

(一)有严重疾病需要保外就医的;

(二)怀孕或者正在哺乳自己婴儿的妇女;

(三)生活不能自理，适用暂予监外执行不致危害社会的。

对被判处无期徒刑的罪犯，有前款第二项规定情形的，可以暂予监外执行。

对适用保外就医可能有社会危险性的罪犯，或者自伤自残的罪犯，不得保外就医。

对罪犯确有严重疾病，必须保外就医的，由省级人民政府指定的医院诊断并开具证明文件。

在交付执行前，暂予监外执行由交付执行的人民法院决定;在交付执行后，暂予监外执行由监狱或者看守所提出书面意见，报省级以上监狱管理机关或者设区的市一级以上公安机关批准。 《刑法》

第四十九条：【死刑适用对象的限制】犯罪的时候不满十八周岁的人和审判的时候怀孕的妇女，不适用死刑。

第七十二条：【适用条件】对于被判处拘役、三年以下有期徒刑的犯罪分子，同时符合下列条件的，可以宣告缓刑，对其中不满十八周岁的人、怀孕的妇女和已满七十五周岁的人，应当宣告缓刑：

(一)犯罪情节较轻;

(二)有悔罪表现;

(三)没有再犯罪的危险;

(四)宣告缓刑对所居住社区没有重大不良影响。

宣告缓刑，可以根据犯罪情况，同时禁止犯罪分子在缓刑考验期限内从事特定活动，进入特定区域、场所，接触特定的人。

被宣告缓刑的犯罪分子，如果被判处附加刑，附加刑仍须执行。
